IHC dismisses representation filed by five judges against new seniority list

IHC dismisses representation filed by five judges against new seniority list

Islamabad High Court rejected the appeal made by five judges regarding the change in seniority principle.

Chief Justice Aamir Farooq made a decision on the appeal, stating that the seniority list at IHC was maintained even after judges were transferred from three provincial high courts. Justice Sarfaraz Dogar, who was transferred from Lahore High Court to IHC, will remain a Senior Puisne Judge.

Chief Justice Aamir Farooq clarified that judges transferred from provincial high courts do not need to take a new oath as they already took one when they became High Court judges. The decision emphasized the distinction between the appointment and transfer of judges.

As a result, the appeals of Justice Mohsin Akhtar Kiani, Justice Tariq Jahangiri, Justice Babar Sattar, Justice Sardar Ijaz Ishaq Khan, and Justice Saman Rifaat were rejected.
